Legal Question in Landlord & Tenant Law in New Jersey

My brother and I were recently named on the deed to a two family house owned by our mother. I live in the house along with another tenant. My brother would like to occupy the tenant's apartment. The current tenant does not have a lease. Can we just ask the tenant to vacate or is there another process we must go through?

There is a formal 2-month legal notice to quit with demand for possession that must be served upon the tenant upon the expiration of the tenant's term.

You should retain an attorney to serve the notice to quit and follow through with a complaint.
