Can I be charged double the rent

My lease expired on 9/17/07 and the landlord wants to double my rent as long as I stay there can they do this and do I have to pay it, or can I just pay my base rent. I am moving out on10/25/07. And the Judge told me that in New jersey that the law is that I must pay the landlord double the rent.

I'm confused. What judge? If your lease expired on 9/17 how is it that you could have had a hearing by 9/28?

Re: Can I be charged double the rent

OK, another question where I know you are not telling the truth or the whole story. You can NOT have appeared before a judge at this time IF your lease ends 9/17. Generally, before a LL can increase rent, they must have given you written notice. If you do not leave at the end of a lease, you are a "holdover tenant". In commercial leases, generally a hold over tenant becomes a year-to-year tenant, where in residential leases, the holdover tenant becomes a month-to-month tenant. Unless there is a notice of a rent increase, the holdover tenant pays the rent dictated in the lease, which could include a yearly increase. I do not believe a doubling of the rent would be allowed by a court, as it would probably be unreasonable, but that is a fact sensitive question. --- You can not get helpful answers unless you tell the truth, and you include enough information.
