deposit for an apartment

i gave my landlord a 890 dollar deposit to hold an apartment for me until the security is paid. an she said she will refund it back after the security is paid by an social service agency. it has been 4 months she refuse to return it and i need the money badly for school. can i sue her for more than the mount for inconvenience.

You can consider writing your landlord a letter to state that you want the $890 applied to the next month's rent. They you are basically getting the money back without suing. Be aware that she can try to evict you for nonpayment of rent, and you will have to appear in court and explain the situation to the judge. This may be inconvenient, but suing her to get back the money will be inconvenient as well. If she tries to evict you, you should be sure to bring the unpaid rent (plus any late fee) with you to court in case the judge does not agree with your position, so that you can pay rent that day and avoid eviction.
