Legal Question in Landlord & Tenant Law in New Jersey
I filled for evicted of tenant due to nonpaypment she agread with the judge to vacate and at that time the judge said we would need to sue in special civil for balance of lease if a new tenant could not be found. Well we found one but that did not turn out well can we go back and sue for the balance owed since its vacant again??

If your tenant breached the lease, you are entitled to the damages that the lease provides. That would usually include any loss that you incur as a result of the breach. The gross profit from a second lease is applied to reduce the amount owed by the first tenant, but the second lease does not substitute for the obligations of the first.
