Legal Question in Landlord & Tenant Law in New Jersey
Good afternoon
I have a room ate who moved in on Oct 15 2010.
On Oct 15 2010 I and my roommate signed a contract stating that she must give 2 weeks notice if she decides to move out.
One week before rent is due she tells me she moving out, which is obviously not 2 weeks notice.
so she pays her rent and gives her two weeks notice for next month
she is now asking for half of her rent back because she not staying the whole month of November. my question is can she do this, do i have to give her half of her rent back because she doesnt want to stay the whole month after we signed an agreement

rent is payable monthly. unless your agreement says that you and she are splitting rent by half months, then this is monthly. Sounds like you do not owe her a half month rent. Let me know if you want a lawyer to assist you.
