Legal Question in Landlord & Tenant Law in New Jersey

with holding rent

Can I with hold rent due to noise from apartment above me, and not being able to sleep, and my husbands lost wages due to no sleep. And my daughter had to be removed from school due to not being able to sleep, and now has to be home schooled. I have complained to management many many times. And they dont do anything about it.

Greetings- The Courts frown upon any types of self-help, whether it be by the landlord or the tenant. If the landlord does nothing to abate the noise condition, hey may be in breach of the lease and you may be able to end the lease early and vacate the premises. It is hard to say exactly what specific remedies are available to you based on the limited information provided.
