Legal Question in Landlord & Tenant Law in New Jersey

no CO on house i am renting house in poor condition LL can't/won't repair, the roof leaks into my bedroom when it rains heavy cascading down my bedroom wall. Last week we had heavy rain and now there is an odor of mold. The landlord attempts to make all repairs himself, technically the house is ininhabitable...roof leaks, windows broken or nailed shut, basement leaks, bathroom has no heat, bathroom shower wall rotted about to collapse and much more. What are our legal rights, there is also no CO on the house.

I would suggest contacting the local code enforcement official in town and see if he will take any action. Another possibility is to escrow the rent until the repairs have been completed.

You can escrow the rent (hold it back and put it into a bank account) but you have to do this the right way. You can call the town and tell them to send the construction official, Midland Park is pretty good on this. You can find out if your apartment is illegal due to no C of O, and maybe if it is you may have a claim against the landlord. It sounds like a nightmare.
