Legal Question in Landlord & Tenant Law in New Jersey

Land Lord problems

My fiance, my 2 year old son and I moved into an apartment 4 months ago. Shortly after we moved in we started getting bit by bugs. The landlords brought in an exterminator that said they were bed bugs. They began blaming us saying we brought them when we have never had them before. The exterminator have been her several times and we are still getting bit. We asked to be let out of our lease and our security back. They agreed to let us out of the lease but wont give our security back. I would just like to know what our rights are.

Re: Land Lord problems

You have the right to the return of your security deposit. Whether or not your lease explicits states it, there is an implied warranty of habitability in your residential lease. An infestation of bed bugs would be a breach of that warranty, and would warrant the return of your security.
