Who Is Their Landlord?

An individual owns a one-family

residential house in New Jersey. He

does not live there. His brother, who

also does not live there, rents this

house to a family. The brother signs the

lease and receives all the rent payments

as the landlord. The homeowner has no

financial interest in this rental, nor is

his name on the lease. As far as the

tenants are concerned, in the state of

New Jersey, who is legally the landlord?

As you describe it, there is no landlord. Brother has no right or ability to let the premises since he does not own it. The tenant's rights and obligations are somewhat confused and depend on who is asking what question. The true owner can probably get the rents from Brother but may give up some rights to the tenant in doing so.
