My tenant has given me a check on time but has an attorney still reviewing the lease. It has different terms than previous lease. If I cash the check I am afraid I would be accepting any changes in the lease that the atty. might suggest. Therefore since I feel I cannot cash the check until I receive satisfactory terms of the lease signed by tenant - if the lease becomes more than 5 days late - can a late charge be assessed.

Based on the limited information presented, I can give you only limited responses.

I suggest you proceed carefully. Tenant has an attorney reviewing? that sounds like a commercial lease. I have NEVER seen a residential tenant hire their own attorney.

I advise you to get your own attorney to look this over for you; you are correct, you do not want a claim that the prior, lower rent amount is now agreed to for another year (or whatever the lease term is).
