My tenants have been given notice to vacate by july 1st. They still have not paid rent for may, and i would like to mention they are section 8. Do i have to give them notice for non-payment of rent before i take them to court for eviction. The reason i gave them notice to vacate is because i am moving back into my home not for non-payment of rent, but i do expect to get paid for the month of may and june. Also, they have the windows open all of the time, without the screens pulled down, and i am afraid that it will allow rodents and insects into my home. Can i just tell her without it looking like i am harrassing her or do i send her a letter? She is very vindictive at this point.

You have a very typical problem. When does the Section 8 agreement end? You will want to make sure that the housing authority at least will pay you its share for may and june.
Next, you would like to get the tenants to pay their share. notices for nonpayment, then suit....yes, all of that should be done correctly, which is a lot easier when you have a lawyer. You should hire an attorney who does a lot of landlord-tenant law in the county courthouse for the town in which your property is located. If that is S.Plainfield, then it is Middlesex Courthouse, in New Brunswick.
