Landlord/Tenant Court Eviction
I withheld my rent because of no hot water. I also later on did not have any heat (during the winter).
My LL took my to court about one year after the no hot water problem which he was aware of (his repair man gave me a temporary cold water source in my kitchen).
I was not notified of this eviction. Rec'd warrant for eviction. Submitted an order to show cause, but the court tells me that the case is inactive with a default against me. I realize I can file a motion to vacate that default against me, but can't find that form.
I also believe that it is retaliation, but realize this can be hard to prove.
There was also a settlement agreement that was submitted but never really filed with the court. I have been paying my rent and only promised an abatement but have not rec'd any abatement money yet.
This is a bit complicated because the court does not seem to file some documents for some reason. I am not sure if it is the court the lawyers who are not following through.
