late fees
if rent is due by the fifth of the month is it late on the fifth or do I have until 12:01 am in new jersey

I would read "by the 5th" to mean any time up until 11:59 PM on the 4th. Does your lease say "by the 5th" or "no later than the 5th". If paying on the 5th makes your life easier, I can't imagine this couldn't be negotiated with your landlord. Any check delivered in the afternoon of the 4th is never going to be funded until the 5th anyway (at the earliest).
