Re: Lead paint
You will need to have a qualified attorney prepare and serve a Notice to Cease and if the lease violation is not corrected then a Notice to Quit with Demand for Possession
Re: Lead paint
Unless the lease, or city housing regulations, restricts the number of occupants, there is not much you can do about the new child. However, you should at least write a letter, or have an attorney write one, that puts the tenant on notice that there is lead paint in the apartment. You should check with the city to make sure that the lead paint is not a violation. Any further comments would have to rely on a review of the lease itself and local ordinances. Call for an appointment. Mention LawGuru and the first half hour is free.
