lease agreement

If my lease is for the term of 1 year- Sept. 1, 2008 to Aug. 31, 2009-and I signed my renewal contract in May 2008, is it legal and binding today-Aug. 26, 2008? Can it be revoked with no penalty?

Whether the lease is binding or not has little to do with the term of the lease. If everything else is in order, the lease is a binding contract even though the term has not started. However, if you are looking to avoid the lease, read the contract carefully. Some leases say that they are not binding on either party until the landlord signs and returns a signed copy to the tenant. So, terms like that may provide a way out depending on the facts.

It is legal and binding unless you have some basis for declaring the lease unenforceable due to some failure of the landlord to abide by the lease or to maintain the leased premises in a habitable condition.
