Legal Question in Landlord & Tenant Law in New Jersey

Legal Rights of Lease Signers

i am a woman who has lived at a rental property with her boyfriend for the past 10 years - both names are on the lease -- as co-signsers do either of us have any legal rights in saying who and who not either can have at the residence? this would be equally important if the relationship should dissolve but both choose to remain at the residence for the duration of the lease?

Re: Legal Rights of Lease Signers

Tenants can have whomever they want in their apartment for their "peacable enjoyment". In other words, if you can not work out who and who will not be allowed in the apartment, there will be fights, and if the fights escallate, eventually it will bring in the police and the courts. If you break up, don't be dumb, one or both of you just move, because you KNOW that will end up causing a problem.

Re: Legal Rights of Lease Signers

If both of you are on the lease, then both of you have the right to have whoever you want into your rental property.

Clearly, you have a problem. You need to plan on how to make changes, either you move out or he moves out, or you both move.

Your question is pretty clearly part of some larger issue, and it is very VERY likely that you need accurate legal advice before taking any step.

If you do not take my advice, then please do keep my telephone number handy. If it becomes a problem, then instead of spending a couple of hundred dollars on a lawyer ahead of time, you will be paying me (or someone like me) thousands and thousands of dollars to clean up the mess which has been created.

I have been doing this kind of work for quite a while. Please do not let this kind of disaster happen to you. Please do go see a lawyer FIRST.

If you would like, give me a call; I am in Hackensack (northern New Jersey). I will be happy to discuss this with you; a brief telephone consultation will be free.

My contact information can be obtained from the links below, just click on the Attorney Profile link. Let my secretary know you found me through LawGuru.
