Legal Question in Landlord & Tenant Law in New Jersey
I live inNj..rented a room from a nice woman whose home was her elderly parents home. There was no lease as we became friends..and I paid on timefor a year. In June, Janice passed away. Her father had passed away the previous March, and her mom was in a VA hospital. She had all their bills in a trust that she paid faithfully. When Janice passed, her accounts had to be stopped as her son stole money out of her account. Her brother, in CA did this. Unfortunately, the utilities were still billing on autopay through Janice's account and the bills added up. I put the gas bill in my name and paid $510 of that, along with paying the electric bill and the water bill. Her brother has not paid a dime through a new trust as he says he is having trouble getting access to her estate and the parent's trust. He now wants me out this Saturday! What recourse do I have?

You do not have to leave on Saturday unless there is a court order resulting from an eviction suit. Your would know about this. You are a tenant and, in New Jersey, only a Special Civil Part Court Officer can remove you from a rented premises pursuant to an order of eviction. I recommend that you discuss the matter with an attorney in your area who handles landlord/tenant matter. If you qualify, you may be able to get help from Legal Aid. Since you are in the premises legally and have been paying the utilities, you have some rights that the new landlord may find difficult to defeat at least for a while. Ultimately you may have to find a different place to live but that could be some time in the future.``
