Legal Question in Landlord & Tenant Law in New Jersey

Hi my mom rented a room in the attic and the person doesnt pay the full rent. She (tenant) also brought a boyfriend there which is always beating on her. My mom had to call the cops 2 times because of her screaming for help and all the noise that shakes the entire house. She asked to by my mom and myself to go and empty the room. She said she was not going nowhere and she will not give any money either. We have no idea what to doto get her out. thanks

If she is not payiimg rent, then you can go to Court and file a Complaint for eviction for non payment of rent, she cannot live there for free. If she and the boyfriend are constantly making noise, you need to send her a notice to cease before you can move to have her evicted on other grounds. Question, does she have a lease with your mother?, also, is the apartment legal? because that could be a problem for your mother as a landlord if the apartment is not legal. You first need to talk to a lawyer before you do anything. If the apartment is illegal, you may have a big problem. If the apartment is illegal, then you may have a big problem even if a Judge understands all of the horrible things she and her boyfriend are doing, and even if she is not paying rent.
