Can a case be thrown out,If a motion was filed using only the persons middle and last name?

A motion is a request to the Court by one of the parties to a case for an Order granting some form of relief. Usually, only a party to an action can file a motion in a case. If the motion clearly identifies the person makeing the motion as a party to a case it will be considered.
