Legal Question in Landlord & Tenant Law in New Jersey

I have moved to one 1st floor apartment on 11th of Nov with rent of 1425 .After staying there for 20 days. Landlord requests us to move to top floor in same building. But we don�t like the new place and on 3rd of Dec we said we will be moving out from this place. I had sign lease for 6 month for 1st floor apartment. Can I moved out legally and ask him to return my security deposit in stipulated time prescribed by law. And would this agreement still valid or Void as soon as we moved from 1st floor apartment

One more thing I want to highlight here owner twice or thrice enter on my 1st floor apartment in absence of me or my wife.

What should i do now to safely exit from this situation with my security deposit

You can stay where you are until the end of the lease. After that, the landlord is obligated under NJ law to offer you a new lease on the same or reasonable terms. In other words, you don't have to move to the top floor even if the landlord wants you to do that.

If you want, you can negotiate with the landlord for a change to the lease that would permit you to move out early. Perhaps the landlord wants that because he has something else in mind for where you are. However, the landlord cannot force you out or force you to change the premises.
