Legal Question in Landlord & Tenant Law in New Jersey

permits

i have a life estate tenant in a home in which i am the remainderman. In 2003 unknown to me, she converted from oil to gas heat. Tank is still underground & not sure if it contains oil. I just recieved word from city clerk there was never any permits to do the job. I don't live on property, she is 95, upon her death when house reverts to me am I responsible for tank removal? I don't have the means to do so, I had nothing to do with it to begin with. In will stipulates she is responsible for maintance,upkeep,taxes,water etc. & has done things that I never approved of. House is in need of repair & I don't want to be responsible for anything after her death. How do I go about getting her to remove tank?
