Legal Question in Landlord & Tenant Law in New Jersey

I have been renting a room in the basement of a house for the last year and a half. There was an electrical problem and the inspectors told her that the basement apartment is illegal. I need 2 months to save the money for the new place. What are my legal rights? How long do I have if the inspectors say I need to leave?

The New Jersey Supreme Court concluded in Miah v. Ahmed, 177 N.J. 511 (2004) that tenants who are evicted as a result of a zoning ordinance violation for an illegal occupancy are entitled to relocation assistance constituting six months of monthly rent regardless of the tenant's actual expenses. The sum must be paid by the landlord prior to eviction, and the landlord cannot reduce its obligation by the amount of past-due rent or other damages. The decision is based on N.J.S.A. 2A:18-61.1h and resolved questions of law about application of that statute. So, your landlord should give you the six month's rent and then you will have what you need to move. If the landlord refuses, consult a lawyer in your area who practices landlord/tenant law. See also: http://info.corbettlaw.net/lawguru.htm
