Legal Question in Landlord & Tenant Law in New Jersey
Rights as part owner in condo
I have been the primary caregiver for my
mother these past 11 years; she died last
month from cancer. We were living in a
condo--my brother owns 70%, and my
sister and I own 15% each. I'm still in the
condo now. There is no mortgage.
Now, my adversarial brother wants to sell
the condo.
1) As a part owner, can I get evicted?
2) As my name also appears on the deed,
can he sell without my agreement?
Thanks.

I could only guess at the answers. My guesses are likely to be correct, but you can not rely on that.
Get a lawyer involved NOW. Before your brother does something that hurts you.
Eviction: I guess that if you are part owner, he should not be able to evict you without a Court order. That is a guess.
Sell: I also guess that if you are part owner, he can not sell without your signature or a Court order. That also is an educate guess.

He will not be able to sell the condo without either your participation therein or a court order.
