security deposit & renting with no CO

we have been renting a home in NJ since 4/15/05 for $2000 a month. The landlord never put $3000 into escrow account or paid interest, also he never had a CO from township to rent until a year later. I asked him for interest and he told me it was not in lease agreement to pay interest. The lease expired 3 years ago and was never renewed. Should I not get my deposit back & interest, and can I apply the first year we paid rent with no CO to future rent because he had no legal right to collect rent with no CO?

You could use your rent deposit as rent credit. You must go about it the right way.
