Legal Question in Landlord & Tenant Law in New Jersey

I rented a 3 bedroom apartment, the tenant did not want to sign a lease agreement.She been living in the apartment for about year I let her stay. About a month ago she said she will not pay rent and she will live what she gave me for security deposit and now she doesn't know whether she is leaving or not. What can I do to so she could leave the apartment.

Eviction!

You need to file an eviction action to get her out. She is in the apartment with an Oral Lease and has not paid the rent. Telling you to keep the security deposit is not paying the rent.

You should go to the clerk of the landlord/tenant court in your county and file a complaint to regain possession of the apartment due to the nonpayment of rent. The security deposit can not be used to pay rent without your consent.
