Legal Question in Landlord & Tenant Law in New Jersey
tenants
i have rented to a woman and her
4 children since jan 1 2007. her rent
is paid through a state rent assistance program. i took her to
court on march 6 because of non-
payment of rent because her assistance was canceled due to her mishandling paperwork when she moved in. at court she came up
with all the back rent. but what
about next month, and besides
she is very loud and has other
people staying there and she
babysits over kids(OVERNIGHT)
i did not give permission for this.
there is no lease can i evict her asap. this is two bedroom apt. also
we a verbal agreement as for her
kids to be quiet. they slam doors
scream and run even at late hours
can i get a response thanks

Re: tenants
The fact that you don't have a written lease is irrelevant. If she/her kids continues to be loud, you need to file a Notice to Quit and only after that can you file a Notice of Eviction.
Courts are not going to evict tenants just because they have overnight visitors (they don't need permission for that), but if the visitors are more like tenants, or if she is running a babysitting business out of the apartment, that would be a different issue.
Your options for eviction are dependent upon the rental setting (# of units/do you live there too?)
