Legal Question in Landlord & Tenant Law in New Jersey
tenants rights
I live in an apartment complex which they are now turning into condos, they have torn up the grounds and the entire place is a noisy dangerous construction zone. they will want access to my apartment for several weeks to tear out walls and windows, what are my rights? I have a 16 yr old son do I have to allow them access, and what about my quality of life with all the noise and construction, not to mention all the illegals that have keys to the common areas?

Re: tenants rights
You are entitled to the same rights and covenants that were included in your lease when you signed it. The condo conversion does nothing to abrogate these. In addition, there are some very specific and timely notices that you must receive from the landlord prior to this conversion. If you wish to discuss this further, plesae contact my office for a free consultation.

Re: tenants rights
Which of your rights are imporant depend a lot on what you want to do. Simply stated, you need give the landlord only the access that is stated in the lease. My guess is that when you find the paragraph referring to landlord's right to access, it will contain the words "reasonable" and "convenient." If not, those words will probably be implied. So, probably the landlord will violate the terms of the lease if it is asking for frequent access for weeks. A second point is that the lease entitles you to the "quiet enjoyment" of the premises. It seems that has been violated too.
You have a number of remedies. Which one you elect depends on how you want to come out of this. You need a lawyer to assist you in determining what you can do and to help you get what you want. If I can be of further help to you, call or email.
