Legal Question in Landlord & Tenant Law in New Jersey

Un-wanted Guests

I own a single family house in Buena, NJ. Recently I helped out a friend who lost her job. She asked if she and her son could stay with me until she found employment and an new apartment. I agreed to allow her to stay with me on a temp basis. She pays no rent and contributes very little if anything.

That was months ago and she still has not found an apartment or a job. I want her out of the house, but when i tell her she must go, or i call the police to have her removed. they tell me that i have to give her 30 days notice in writing hand delivered and certified. If she does not go, i have to take her to court and have her evicted!

I can understand this if she was a tenant, but she is a guest staying in my house because of my generosity!

Why do I have to have her evicted?

Is she trespassing if she is in my house with out permission? Should the police/sheriff remove her?

Do i need to press charges?

HELP!

you are going to want to consult an attorney who does a lot of landlord tenant law, who is not too far from you in Buena NJ.
