Legal Question in Legal Ethics in New Jersey

Internet Liability Question

I just started up a babyboomer social club on yahoo.com. No one has met yet but an event is upcoming. One of the members mentioned that she doesn't drive and another male member offered anyone a ride that needs one. This made me wonder if

I could be held accountable in any way being the website

administrator for this group. Just in case something happened to one of the members due to joining this website. Do I need to have members sign a disclaimer form or some kind of contract where I would not be responsible if anything happened? I am very anxious for a reply since we are planning an event shortly.

Thank You very much.

Re: Internet Liability Question

Your situation is quite interesting, and you are right to be concerned. It is possible that a jury may decide that you are liable in some sense, at fault, for some woman agreeing to enter the automobile of a total stranger, a man, because of your action in setting up this club and the meeting. That is possible despite the crystal clear dangers, serious and avoidable dangers. I can not predict what a jury, and judge will decide in your situation. It is also very difficult or impossible for you to get hand-written signatures from the members of your internet club acknowledging this problem and giving up any claim against you arising out of the club; it is not clear whether such a waiver will be enforced or not. There are some steps that you can take to reduce the risk, including making clear statements that NO ONE should accept an automobile ride from strangers, and posting that on your website and elsewhere. I have some other ideas for you as well. Please call if you would like me to assist. 973 890 0400
