Legal Malpractice/Professional Ethics
My mother was recently misrepresented in New Jersey by a divorce lawyer. She now has to look for a new lawyer to represent her in a future proceeding.
- Under what conditions, can she get her retainer back from her first lawyer?
- What would be the aspects to think about regarding suing her first lawyer for legal malpractice?
- What sort of procedure is it (and when should you do it) to make charges against her first lawyer to the State Ethics Board?

With respect to questions, you might wish to consider discussing all of these questions with your new attorney familiar with contract law in your state as well as family law.
