Legal Malpractice/Professional Ethics

My mother was recently misrepresented in New Jersey by a divorce lawyer. She now has to look for a new lawyer to represent her in a future proceeding.

- Under what conditions, can she get her retainer back from her first lawyer?

- What would be the aspects to think about regarding suing her first lawyer for legal malpractice?

- What sort of procedure is it (and when should you do it) to make charges against her first lawyer to the State Ethics Board?
