Legal Question in Legal Malpractice in New Jersey

legal malpractice - pension

Was divorced 11 years ago. Attorney advised not to negotiate ex's federal pension because it would continue after his death. Ex just retired and have now found out that original divorce attorney did not use proper language and that I have no surviorship rights. Is this a case of malpractice.

Obviously, the small amount of information that you have given is very troubling. You need a careful analysis and guidance. Did you waive and give up all rights to ex's pension? that would be very bad indeed. if nothing was done, the issue was left open, you then have to go back to Court.
