Legal Question in Medical Malpractice in New Jersey

On Fri Sept 1 I went to my ob-Gyn for my regular 35 week pregnancy check up and told him the baby was not really moving that much.I had told ther doctors in the past couple of months that she was a very quiet baby and didn't kick that often maybe just squirm around.

On that Fri he checked the babies heart beat and told me to drink some orange juice.I called tues morning ,they told me to comein .THey sent me to labor and delivery for an ultra-sound and there was no heart beat.

We were just informed also they lost the babies placenta so there can't be any testing.

We are heart-broken and need some answers.

I am very sorry to hear about your loss. As the parent of four, one with special needs, and having represented families in similar situations to yours, I know how tryng these times can be.

The initial answers that can be had will be contained in the medical records. I would suggest that you have the records reviewed by an attorney and/or medical experts that the attorney can hire. It seems highly suspicious that anything is "LOST" or missing, and for that reason alone, perhaps an investigation should be done.

If it turns out that something looks wrong in the records, then further information can be gathered through legal proceedings. In some cases, the only way to obtain the full medical records is through such proceedings.

I am sorry for your loss. We would be happy to investigate whether your loss was preventable and whether someone should be held responsible.

Based upon the facts that you posted, it is too difficult to tell. We would obtain the medical records and have them reviewed if it appears that this was preventable. Once they are reveiwed, we can tell whether malpractice has a role in this loss.
