Legal Question in Medical Malpractice in New Jersey

My dentist was arrested for using the name and dental license of a dentist that died in 2001. My dentist lost his license in 2004 for insurance fraud. He performed procedures on me with no license. Can I sue him?

Yes, and it sounds like you should go after him right away. Get a lawyer who handles malpractice, right away!

First - when did you find out about the procedure being performed with no license? You may be out of time.

Second, even though he did not have a license, did he actually perform the procedure properly? That would affect the value of the claim, and impact whether an attorney would take the case and pursue it.

Third - yes, you do have a claim, but in medical malpractice cases, many valid claims are not pursued since the expense and time involved do not justify the pursuit of the case. I can only make that assessment after a more detailed understanding of the facts.
