Legal Question in Medical Malpractice in New Jersey

Interested in suing a doctor...

I am interest in going after a doctor. A day after giving birth to my daughter, I recieved a visit from DYFS because someone had called stating that my fiancee was giving me drugs (mind you, not even 24 hours earlier, I was giving birth). That claim was quickly disproven with a drug test but another claim arose when I tested positive for Benzodiazapine (a sedative commonly used in concious sedation which is what I recieved for my c-section). My doctor said that every other drug found in my body was exactly what the hospital had given me with the exception of the Benzo. Due to the fact that he couldn't open my file out of either laziness or cockiness, I had to deal with a 2 month battle to keep my children which ran me several thousand dollars in lawyer bills. Is there any way to go after him for not only the bills but emotional distress?
