Legal Question in Medical Malpractice in New Jersey

lyme

daughter had bulls eye on shoulder doctor said not tick bite no blood work 2006. 2007 knee and shoulder swollen er dr, says get blood work from primary doctor for lyme. blood work positive for lymes. daughter has multiple problems from lyme. can we do anything. she also lost job because of being sick. she is 20 now

I would add that under the �discovery rule� your daughter�s statute of limitations extends no longer than 2 years after she could have �discovered� the Lyme disease. She (she IS an �adult�) should call attorneys NOW, if she wishes to investigate a possible malpractice case,

Whether there is a case will depend largely on what kinds of permanent problems she has, as many problems from Lyme disease will be temporary.

Regarding the care - that is UNFORGIVABLE - a �Target� lesion is CLASSIC Lyme disease.

Before the blood test, which is roughly 20 years old - the �target� lesion was virtually the ONLY way to make the diagnosis. Unless this doctor had an alternate reasonable explanation for the target rash, she should have been treated in 2006 while waiting for the results (or arguably without a blood test!)
