Legal Question in Medical Malpractice in New Jersey

Medical questions

I had my urinary bladder lifted in March 2006. I also had a vaginal hysterectomy at the same time. I've had discharge with a foul odor ever since the surgery. The doctor has been telling me this is normal for up to a year after the surgery. They have taken several urinanalysis which have showed no infection. Today, I went for a second opinion to another OB/GYN and she said that I should go back to the original doctor who did the surgery because the bladder suspension net is loose. My only choise is to have more surgery. My main question is: If I never had a urinary discharge with a foul odor prior to the surgery how can just a loose suspension net cause all my problems? I'm disgusted with living with this problem. It is very embarrassing. Do I have grounds for a malpractice suit.

I think that your concerns about the results are well founded and the suggestion that you merely return back to the same doctor is disconcerting. What you are asking for is somewhat of a medical question and I suggest that you do some research on a medical site to see some of the expected complications, if for no otehr reason to understand what hte doctor explains to you.

After doing some research I would think that you may want to see another doctor to evaluate the problem. Logically, I think that it would seem unlikely that the loose netting would be at fault. But this is a medical issue that must be determined by a doctor.

Assuming that it were something that was other than loose netting, then it may be actionable. Loose netting I udnerstand can be an expected complication.

In any case, generally, there is only usually two years following any wrongful act to bring suit, so you need to follow up on both the medical care and then a legal evaluation in the near future.

in order to have a malpractice claim, you need to show that the doctor did something wrong. Sometimes, people just get a bad result. Bad results are not malpractice. You need to ask the doctor why this happened. Is it possible that the netting was defective?
