Legal Question in Medical Malpractice in New Jersey
septic shock + heart defibrillator
My father was admitted to the ER in N.J. labor day with his heart and inability to breathe. The hospital was unable to regulate his heart and blood pressure (he has an implanted defibrillator). Sat Sept 10 he died of septic shock acquired in the hospital. He was 89 years old. My mother is too distraught to get his hospital records so that I can investigate the matter. Can a lawyer who is a doctor as well request and be given his hospital records as a courtesy for free?

First, let me extend my condolences for your loss. As to your questions, unless you are a medical professional, it would appear that you would benefit from an attorney's assistance. You can obtain records if you want if you have power of attorney. Otherwise, an attorney representing the family can obtain the records with proper authorization. The maximum cost of records is $200, which would have to be paid.
I notet that there have recently been a recall of several different defibrillators and pacemakers, this issue should also be explored.
