Legal Question in Medical Malpractice in New Jersey
My son was cut by lab tech at hospital and as a result, needed stitches. They put the stitches in since the next nearest hospital was quite far PLUS my son was originally there for a head injury. He was only 2 years old at the time and I could not risk leaving there. Anyway, 10 days later, we followed up with the pediatrician who REFUSED to remove the stitches due to liability reasons. He told me my only option was to go back to the hospital who did the stitches to have them removed. I did. I am now receiving a bill for my $100 copayment. I never would have needed to return to the hospital if it weren't for their mistake, but it seems they don't care. What can I do? My insurance isn't concerned either.

You are not going to be able to get a malpractice attorney invovled in the case becuase the limited damages mean that it is not financially viable. I would suggest you call the surgery center and ask them to cover the cost of the co-payment given the fact that they necessitated the care. I don't know if they will agree to that. If they don't you can always file a complaint with the New Jersey Department of Health.
