Legal Question in Military Law in New Jersey

Discharge

In my past life I was inlisted in the military for around 3.5 years. I inlisted in 1991 and was discharged with an Other than honorable classification for being UA in 1995. I have more recently been applying for federal employment as a civilian not claiming veterans status. I have had some success with interviews but I am fearful that my past may haunt me some what when I reach the written portion of that application process. Of course one of the questions aked is '' Have you ever been an Armed Forces member'' I reply yes and give the condition of my discharge. Some I have spoken to say that it shouldn't matter but I need something a little more firm. If this is a undisclosed reason for my not being offered a position with the Federal Government what can I do to upgrade my discharge, if at all possible. It has been 13 years since my release from the military.

Re: Discharge

My office handles Military Records Correction Issues and Federal Employment Issues. You may have some options; however, I need to know more details to better assess the situation.

Feel free to contact me if you would like to set up an initial consultation, free of charge. If we set up an appointment, I'd be happy to initiate the call in order to save you in long distance charges.

Re: Discharge

You have a 15 year deadline to file for an upgrade, so this is a good time to get started on applying for an upgrade.

I myself do not do discharge upgrades but I can refer you to my friend and colleague, Kathy Gilberd. Her contact info is at:

http://kathleengilberd.com/

Kathy is not an attorney but is very experienced in helping GI's apply for upgrades and her rates are quite reasonable. (please let her know I sent you over)

If you want to get an attorney to do it, I'm sure there are many good attorneys you can find on this message board.

Good luck!

James
