Legal Question in Personal Injury in New Jersey
Accident on property owned by deceased relative
My eight year old daughter fell out of a tree at her deceased grandfather's house while visiting her father. She fractured her elbow, had surgery, three pins, and will require at least one year of physical therapy. My health insurance will only allow two months of therapy. How can I put the insurance company for the estate on notice and if there is no insurance, what other choices do I have? What should be my first step?

Re: Accident on property owned by deceased relative
Send a letter by certified mail to the Executor of the estate indicating your claim. However, you really would need an attorney to process the claim for you. In this type of case, there would certainly be a defense that the estate did nothing wrong. A careful analysis needs to be made, with an attorney, of the issues and your daughter's options. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
