Legal Question in Personal Injury in New Jersey

How much is accident worth..

I was a passenger in a taxi cab, he was speeding and totaled the cab...He was issued a careless driving ticket and there is also a witness...My injuries so far are 2 fractures right wrist, fracture of right ankle, 2 herniated discs in cervical collar, one fractured vertabrae in back also spinal stenosis with nerve damage...By the way I am an outside sales rep , Have been out of work since june 4th the day of the accident..I Would like a ballpark figure of how much this case is worth so far..

The value of a case is determined by how much they are willing OR able to pay. Your injuries sound serious and would certainly be worth a substantial amount of money. However, anyone who tells you waht your case is worth without seeing the full extent of the medical reports and the availability of insurance is either a fool or a liar....

We determine the RANGE of value for the case by getting a full set of records, expert evaluation of the injury and documentation of the economic loss. We then look at jury verdicts for similar type injuries and confernece the case with attorneys in the office to come up with a range of value. Based upon consultation with the client, a demand is made. This number is generally substantially more than our anticipated settlement value.

If the defendant's offer is not within the range of settlement values, based upon our experience, then we go to trial.

At trial, the value is determined by a jury. Attorneys cannot suggest a value to the jury, so it is totally up to the layperson's discretion. This is why it is a "crap shoot" of sorts.

If I told you the value of the case, it would be dishonest or disingenous without having seen the full extent of the injuries and what pre-existing conditions existed or not, whether thre is significan permanancy or not.

A case has significantly greater value depnding on the level of permanent injury. How could I honestly assess that based upon your posting?

Your injuries have significant value. However, to give a more specific answer, there is additional information that an attorney would need to know. First, it depends upon what venue (i.e., the county) the lawsuit can be brought in. The selection of the proper venue, in accordance with CPLR Article 5, is of paramount importance in a case like this. Some New York counties' jury are know to award significantly more money than others, such as Bronx County.

Second, the amount of insurance available often dictates, to some extent, the value you can obtain by settlement or, if your case is tried, the amount one will end up recovering.

This is not the easist question to answer. You have indicated NJ law...did the accident happen in NJ?--where do the owners/drivers live? These questions can determine the value of a legal matter. I am sorry for this misfortune.

In NYC, 100T is the minimum insurance required of a commercial livery. But, if he is not an independant driver but employed by a company, there will be 2 million in insurance.

The nerve damage is particularly significant. It indicates permanent injuries. On that basis, your claim will likely exhaust the 2 million policy limit. A settlement for 500T - 1.5 million is likely depending on the details.

If the case is not settled and goes to trial (a jury), the award may exceed the 2 million policy limit. But any excess not covered by the policy will not be paid immediately.
