assault?
A family member was choking me until I could breath and my spouse had to pull her off of me.I want to take legal actions but how do I do this and I sustain injuries that Im seeing a md for.A police report was filed and my kids were home of the incident

No one is allowed to hurt someone else. This is very, very wrong. If your kids (or anyone's kids) saw this, that makes it worse.
That said, do you REALLY want to pursue this?

I generally do not like to answer questions where no zip code is provided. This sounds like an intentional act and there is no coverage generally as one cannot insure against their intentional harm to another. This means you must sue your family member for their personal assets. This is tough on the family. You could file a criminal complaint and seek compensation from the VCCB. The severity of the injury will dictate the practicality of filing a civil suit for a judgment thast is only worthwhile if the party has income and unemcumbered assets generally speaking since there is no coverage from insurance unless it was accidental. You should consult a lawyer in the area where you live. If the police know about the violence against you and did not offer to file a criminal complaint or domestic violence restraining order that is a question too.
