Auto Accident- Injuries as a result of negligence
I was involved in an automobile accident last week. I was driving behind a Cadillac Escalade on a two-lane road. The driver of the car turned to the right and it seemed as if she was going to pull over, but what she was really trying to do was make an illegal U-Turn. When I realized that she was attempting to make the turn, I honked my horn and slammed on the brakes. When I did this her car was completely sideways and in between the two yellow lines. It was a rainy day and when I applied the brakes, my car (2000 Dodge Durango) began to skid and slammed into the middle of her car(the driver side and rear right doors). The point of impact on my car was the right bumper, which was destroyed and is now undrivable. I had my seatbelt on, but my head hit the steering wheel when the cars impacted. I got out of the car and stood up, but I instantly felt dizzy and my head was hurting a bit. I was taken to the hospital to get checked out, and luckily nothing was broken. It's been 6 days since the accident, and I've had frequent headaches and dizziness, and a pain in the middle of my back. On the police report, it states that the other driver said that she was indeed attempting an illegal U-Turn. Any helpful information would be appreciated.

While I agree with the other posters that consulting an attorney would be wise, you do not "have to." if you appreciate certain general rules. First, do not speak to the other driver's insurance company. Do not give a recorded statement to anyone, even your own carrier. Get medical treatment. From a liability standpoint, and admission as to fault on the police report from the otehr driver means your rates will not go up. It does not mean that you won't be assessed some level of fault by your own carrier, i.e. 10%. If you make any statements, they could be used against you. Not everyone is good with time and distance figures, and they can bite you later on if estimated without thought. My office would be happy to answer any questions by e-mail or phone, or in person.

You should immediately consult an attorney experienced with auto accident cases since steps must be taken at this very critical early stage if you are to properly recover your medical expenses and possibly recover for your injuries. You NEED to consult an atty ASAP. The right atty will help you document your case, AND may help you get the right treatment, which is critical for your best recovery. Believe it or not, I've seen insurance companies try to restrict treatment to save a few bucks, to the detriment of the injured party. Where are you located, perhaps I could recommend someone to you?

I am sorry to hear about the pain and associated problems stemming from another drivers negligence. You should begin to get medical treatment immediately. You should also consult an attorney so that the carrier knows that they cannot tread on your rights to medical treatment. We could then explore a law suit against the other driver.
