Legal Question in Personal Injury in New Jersey
auto accident in new jersey
I was recently involved in an accident and the police report favors the other driver. The driver asked to go to the hospital complaining of neck/back pain. I have reported it to my insurance company. Two weeks later, I rec'd a letter from the other driver's lawyer asking for my insurance information with the indication that they were seeking compensation for ''personal injuries''. I have 100/300/50 policy. Can he seek compensation from me personally? Do I need to contact a lawyer on my own?
- Thank you

Re: auto accident in new jersey
You can get a personal attorney, but it is not necessary. The insurance company will provide you an attorney and has a duty to protect you. You position should be that you do not care what they settle if for, so long as they settle the case within the policy limits. That way, if they chose not to settle, then it is their obligation - that is called bad faith if they do not protect you.
Of course, if the plaintiff indicates that they are unwilling to accept the policy from the beginning, then you would have potential personal liability. That would be highly unusual.
I hope this helps. Please feel free to contact me if you have any questions.
