Legal Question in Personal Injury in New Jersey

how are benefits affected when moving to another state

If I moved to another state and am currently still (accident happened 1984)collecting medical benefits from the JUA (joint underwriting assoc)will NJ pay for that other state costs at 100% or will I be responsible for the difference of the NJ fee schedule charges and what the new out of state dr is charging?

I have lived in NJ all my life and want to ''start over'' in California or Arizona.

If you can not answer this, I really do not want to involve an attorney, where can I research to find my answer? My claim examiner can't or won't tell me.

Thank you.

Re: how are benefits affected when moving to another state

Typically the medical bills are goverened by NJ law. The health care providers in other states do not have to comply with NJ law in following a the fee schedule. The JUA does not have to pay beyond the Nj fee schedule. Unless you can get the provider to follow the NJ fee schedule, you will be responsible to the provider for the difference. The only reservation about that advice would be whehter your new state has some type of law requiring recipricol benefits, which is highly unlikely.

Cahnces are that the reason the adjuster won't answer your question is that they do not know. Perhaps you will be fortunate enough for them to pay the bill without question; I have no great confidence in this either. Good luck and best wishes.
