Chances of getting an advance on guarenteed settlement funds
I would like to know if attornys are in anyway, shape, or form, are able, willing or even obligated to offer an advance on the settlement funds from a personal injury case. Since being involved in the accident, I was unable to work for 2 months due to a head & knee injury, which in turned caused severe financial hardship in which I still am unable to recover from. I have lost my car, my apartment, and Iam struggling to pay my childs tuition. what are the chances of asking my attorney or his lawfirm ( and them accepting) an advance on my settlement?

A: Impossible, unless your attorney wants to risk
turning his license in to the state. It is unethical
to advance money to a client on a potential settlement.
Unfortunately for some accident victims, economic pressures
are exerted in addition to the physical disabilities from
an accident.
There presently exists no system which would allow
an attorney to advance funds to a client even if the
lawyer was attempting to assist the client as a humane
gesture.
Maybe you can get the legislature to change this law. There
should be a way that an attorney could advance some monies
to his client openly and have the court approve the advance.
Such a law would assist many needy and desperate accident victims.
