Legal Question in Personal Injury in New Jersey
Child injured in school
2 children were injured in a charter school. A hutch/shelf tipped over, falling on 2 children. 1 child got a concussion & was out of school for a week. The other got a superficial cut on the top of her head that took a 2 weeks to heal. She was able to return to school after 2 days, but the wound was still healing.
I have two questions:
1. Are there any rules or laws about securing any kind of furniture for the childresn safty?
2. Are there any standard rules, laws or procedures school staff must take after such accidents?
Neither child was taken to the hospital by the staff. The school nurse advised us that our child might need stitches, yet no one took her to the hospital. The second child blacked out & had blurred vision, yet she was not taken to the hospital either...
The hutch/shelf has since been thrown out by the school staff.
Is there anything we can do? Is it even worth it?

there are codes that describe how it should have been secured. experts in the field would need to offer that opinion. As to what to do folowing the incident, the school should have rules and regs. If further harm came becaue the child was not sent for medical care, there may be a claim against the school
