Legal Question in Personal Injury in New Jersey
My child was Injuried at school
In the state of New jersey are you allowed to file a case if your child gets hurt at school? My child fell at school last week she tried to tell the nurse and her teacher that her arm was broke and they did not believe her. The nurse called and said that she had fell and that she had some minor swelling but she didnt see anything wrong. She was sent back to class where she tried to tell the teacher and at this point the teacher thought that she was over reacting. So the teacher called me later that eveing and let a message on my phone talking about my child behavior in class that day. Well she forgot to hang up the phone and starting imitating my childs behavior in class that day and making it as a joke she also said that the was anoying and that she ok until my child gets to school. And this is the teacher that's teaching my child. I took her to the er the following day when they took a ex ray they said that she had a broken bone and a facture in her wrist from falling. Do you think that I have a case here?

Re: My child was Injuried at school
I am sorry to hear that your daughter was injured at school, and hope she is recovering well. It is important, if a claim can be made against the school, that you act promptly to retain counsel who will proceed accordingly to make sure that any applicable Statute of Limitations rules for a claim against a school are adhered to. This firm has handled many claims of this nature; however, we'd require some additional information to determine if the claim is pursuable. Please feel free to contact me or any of my partners at the Blume Goldfaden Firm via the profile information provided on this site. We look forward to speaking with you, and will assist you in any way we can.

In my opinion, the strength of any potential case depends on where/how she fell...
Do you have any more details?
