Legal Question in Personal Injury in New Jersey

i went to the dentist today and my teeth were fine but when the assistant was brushing them with the electronic brush she was not fully paying attention. The other lady came in and was saying stuff about an old patient who insulted her and had come back. While this was happening the assistant brushed higher then she was supposed to and cut the pinkish skin above one of my teeth. It is swelled and it hurts when i try to bite something. would this be considered malpractice?
